Acknowledgment & Acceptance
Cryptic Quests and the Cryptic Quests website, games and tours (collectively referred to as "quests") are owned and operated by WebExpedience, LLC. By registering for an account and/or registering to play a quest, you agree that you have read and understand the following terms and conditions of use and that your usage of Cryptic Quests shall conform to the terms and conditions herein.
Cryptic Quests reserves the right to occasionally send emails to Account Holders including but not limited to: system updates, changes or notifications; new quest or other business announcements; requests for feedback, etc. Account Holders can choose to stop receiving promotional related email but cannot unsubscribe from Messages related to quests they have registered for or the transactions associated with registering for quests.
Cryptic Quests reserves the right to limit the number of participants who can register for any quest at any time.
Cryptic Quests reserves the right to add, change, or update these Terms of Use or the rules for Adventure, Discover, Treasure, and any other types of Quests at any time.
Terms of Participation
Individuals must be 18 years or older to register for an account or play a quest. However, in order to be eligible to claim a prize from winning a Treasure Quest, registrants must also be U.S. Citizens or Permanent Residents.
A business "entity" is NOT eligible to register for an account or a quest.
Account Holders agree to provide only true and accurate information to Cryptic Quests at all times. Account Holders also agree to comply with the terms of all Cryptic Quests offers, promotions, quests, and programs at all times.
Account Holders agree not to abuse Cryptic Quests player privileges by conduct which is detrimental to the interests of Cryptic Quests or other players, including but not limited to attempts to interfere with quest play, preventing others from accessing quest play areas, altering quest play locations, hacking or tampering with Cryptic Quests website or servers, or any other action of fraud or attempted fraud. Cryptic Quests will pursue prosecution of fraud or other illegal activity involving our technology or system.
Account holders agree to not make Adventure Quest or Treasure Quest clues or solutions to clues known to other registered players or potential future players. Sharing any such info on social media or other public forum is expressly prohibited and may result in revocation of the holder’s account without refund of any quests registered for but unfinished.
Bullying or disrespect of any kind to another quest participant or to a property owner, employee, or caretaker of locations within the game play area is also prohibited and may result in player disqualification.
Participants may not cause any destruction or littering whatsoever on any public or private land and are responsible for knowing and abiding by all Federal, State, and Local laws, regulations, and restrictions during their quest participation, including but not limited to motor vehicle traffic laws.
Cryptic Quests, at its sole discretion, reserves the right to disable or terminate an Account Holder’s account if it believes such Account Holder has violated or acted inconsistently with the rules of Cryptic Quests or this Agreement’s intent.
Cryptic Quests will be the sole determiner in cases of suspected fraud, abuse, or violation of its rules. Any decision it makes relating to termination of an Account Holder’s account shall be final and binding.
Account Holder shall comply with all laws, rules, and regulations that are applicable to Account Holder, especially while playing a quest. Account Holder acknowledges that Account Holder may only participate in Cryptic Quests if and to the extent that such participation is permitted by such laws, rules, and regulations. Cryptic Quests refuses to enroll Account Holder, or to restrict, modify, or terminate Account Holder’s participation in Cryptic Quests, without liability to Account Holder or any other party, if Account Holder violates any law, rule, or regulation, or if Account Holder’s participation in Cryptic Quests could violate any law, rule, or regulation.
Equipment Needed
In order to participate in Cryptic Quest game/quest/tour play, Account Holders must register for the quest and have an Android or IOS cellular phone or other device (such as a tablet) with active cellular service, GPS capabilities with location turned on, and internet access with available mobile data. Cryptic Quests does not provide equipment for participation. Cryptic Quests is not responsible for game play issues related to weak cellular signal, environmental or other interference, or software, hardware, or other malfunctions, inaccuracies, or incompatibilities related to the cellular device used.
Privacy Policy
Cryptic Quests takes Account Holder privacy seriously. Cryptic Quests’ privacy policy can be found by visiting the Privacy Policy link at the bottom of the CrypticQuests.com website.
Disclaimer of Warranties
Account Holder expressly agrees that use of Cryptic Quests is at the Account Holder’s sole risk.
Cryptic Quests and all services offered therein are provided on a strictly "as is" and "as available" basis. CRYPTIC QUESTS MAKES NO WARRANTY WITH REGARD TO ANY PRODUCTS, SERVICES, OR PRIZES OBTAINED BY ACCOUNT HOLDERS THROUGH CRYPTIC QUESTS OR THROUGH PARTICIPATION IN CRYPTIC QUESTS ADVENTURE, DISCOVER, TREASURE OR OTHER QUESTS; THAT CRYPTIC QUESTS WILL MEET ACCOUNT HOLDERS' REQUIREMENTS; OR THAT CRYPTIC QUESTS WILL BE UNINTERRUPTED, TIMELY, ERROR FREE; NOR DOES CRYPTIC QUESTS MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF CRYPTIC QUESTS OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH CRYPTIC QUESTS.
Cryptic Quests expressly disclaims any and all express and implied warranties, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Cryptic Quests shall not be liable or responsible for those guarantees, warranties, and representations, if any, offered by Cryptic Quests partner advertisers, manufacturers of merchandise, or suppliers of services. No advice or information, whether oral or written, obtained by Account Holders from Cryptic Quests or through Cryptic Quests shall create any warranty not expressly made herein.
Limitation of Liability
CRYPTIC QUESTS SHALL NOT BE LIABLE FOR ANY DAMAGES, WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL, RELATING TO THE PARTICIPATION OR INABILITY TO PARTICIPATE IN CRYPTIC QUESTS GAME PLAY. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES; SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
Cryptic Quests is not responsible for damages or losses that result from participating or inability to participate in Cryptic Quests, or reliance on or use of information, services, or merchandise provided on or through Cryptic Quests.
Account Holder acknowledges and agrees that Cryptic Quests neither endorses the contents of advertisements or third parties' Web sites, nor assumes responsibility or liability for the accuracy of material contained therein, or any infringement of third-party intellectual property rights arising there from, or any fraud or other crime facilitated thereby.
In no event shall Cryptic Quests’ liability, either jointly or severally, exceed $100.
Termination
AT ANY TIME EITHER AN ACCOUNT HOLDER OR CRYPTIC QUESTS MAY TERMINATE THE HOLDER’S ACCOUNT WITH OR WITHOUT CAUSE. ACCOUNT HOLDER’S RIGHT TO USE THEIR ACCOUNT IMMEDIATELY CEASES UPON TERMINATION AND ACCOUNT HOLDER’S UNFINISHED OR UNPLAYED QUESTS WILL BE CANCELLED. IN THE EVENT THE ACCOUNT HOLDER TERMINATES, NO REFUNDS OF UNFINISHED OR UNPLAYED QUESTS WILL BE GIVEN. IF CRYPTIC QUESTS TERMINATES THE ACCOUNT, REFUNDS MAY BE GIVEN ON UNFINISHED OR UNPLAYED QUESTS IF THE REASON FOR THE TERMINATION IS NOT RELATED TO PROHIBITED CONDUCT OF THE ACCOUNT HOLDER IN WHICH CASE NO REFUND WILL BE GIVEN.
Should Account Holder object to any of the terms and conditions of this Agreement, or any subsequent modifications thereto, or become dissatisfied with Cryptic Quests, Account Holder’s only recourse is to immediately discontinue participation in Cryptic Quests and properly terminate his or her account by emailing: support@crypticquests.com
Cryptic Quests reserves the right to terminate the account of any Account Holder who appears to be using Cryptic Quests in a manner inconsistent with this Agreement, the intent of this Agreement, or any Cryptic Quests rules.
Non-Transferability
Cryptic Quests accounts and quests are non-transferable and are void if found to be transferred. Clues, quest progress, etc, may not be bartered or sold.
An Account Holder’s account will terminate immediately in the event of an Account Holder’s death.
Cryptic Quests Account Holder accounts and quest progress are not transferable upon death or as part of a domestic relations matter or otherwise by operation of law.
Proprietary Rights to Content and other Intellectual Property
Account Holder acknowledges that Cryptic Quests content (including but not limited to text, sound, photographs, graphics, or other material contained in any Cryptic Quests communication, advertisements, or messages, whether by Cryptic Quests (or Cryptic Quests’ advertisers, participating merchants, or partners), service and software are protected by copyrights, trademarks, service marks, patents, and/or other proprietary rights and laws; therefore, Account Holder is only permitted to use content, service, or software as expressly authorized by Cryptic Quests, its advertisers and partners, as the case may be.
Modifications
Cryptic Quests reserves the right to change this Agreement, and/or any part thereof, at any time. Account Holder understands the most recent version of this Agreement will be located on the Cryptic Quests website.
Account Holder’s non-termination or continued use of Cryptic Quests constitutes an affirmative acknowledgment by Account Holder of any modification to the Account Holder Terms of Service Agreement and consent to abide and be bound by any terms thereof. At any time, if Account Holder does not agree with the Account Holder Terms of Service, Account Holder may terminate Account Holder’s account.
Cryptic Quests reserves the right to modify or discontinue the Cryptic Quests service with or without notice to Account Holder.
Cryptic Quests shall not be liable to Account Holder or any third party should Cryptic Quests exercise its right to modify or discontinue the Cryptic Quests program/service.
Account Holder’s continued participation in Cryptic Quests game play shall constitute an affirmative acknowledgment by Account Holder of any amendment or modification to the Terms of Service "TOS" and Account Holder’s consent to abide and be bound by said TOS as amended or modified.
Notices
All notices given by Cryptic Quests to Account Holder will be given by email, regular mail, or by general posting on the Cryptic Quests website.
Indemnification
Account Holder agrees to indemnify and hold Cryptic Quests, its affiliates, officers, and employees harmless from any claim, demand, expense, or damage, including reasonable attorneys' fees relating to use of Cryptic Quests or violation of this Agreement.
Laws
Any dispute or claim arising out of or in relation to this Agreement, or the interpretation, making, performance, breach, or termination thereof, shall be finally settled by binding arbitration in Missouri, under the Commercial Arbitration Rules of the American Arbitration Association by three arbitrators appointed in accordance with said Rules. Judgment on the award rendered by the arbitrators may be entered in any court having jurisdiction thereof.
This contract shall be governed by the law of the State of Missouri, excluding its conflict of law principles. The arbitration proceedings shall be governed by federal arbitration law and by the Rules, without reference to state arbitration law.
Account Holder and Cryptic Quests agree that, any provision of applicable law notwithstanding, neither party will request, and the arbitrators shall have no authority to award, punitive or exemplary damages against the other party.
This Agreement constitutes the complete and exclusive understanding between Cryptic Quests and Account Holder relating to the subject matter hereof and supersedes all prior or contemporaneous understandings, agreements, communications, and/or advertising with respect to such subject matter.
If any provision(s) of this Agreement is held by the arbitrators to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect.
Cryptic Quests’ failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Cryptic Quests in writing.
